Brad Simpson’s legal team is calling for an investigation into the hearing

BEXAR CO. – The defense team of Brad Simpson, the man accused of murdering his wife Suzanne, is requesting an investigative trial.

According to legal experts, the outcome of that trial could be enough to send Brad home.

Local attorney Adam LaHood is not part of the case but weighed in on the next step in the legal process.

“It’s a hearing that the defense and the prosecution have before a judge or a magistrate, and it’s there to determine a couple of things,” LaHood explained. “First, is there probable cause to continue to detain the person? And is the bond sufficient to detain them if there is probable cause?”

Brad’s defense team will soon face court, where they will hear what evidence the state has gathered so far.

And, more importantly, if the evidence is strong enough to continue holding him.

“If they can get an investigative trial and a judge can look at the evidence that says ‘hey, this is pretty weak.’ You know, there’s not enough here to hold him, then it could result in a bond reduction … or, you know, in his immediate release,” LaHood said. “Which, in my estimation, would … be what they’re trying to go after.”

Brad is being held in the Bexar County Jail on $3 million bail.

He is accused of murdering his wife Suzanne in October, along with tampering with evidence and possessing a prohibited weapon.

But with Suzanne’s body still missing, the defense is racing against the clock.

“If the state doesn’t indict him, which with the grand jury is a little different process and they have 90 days to do that from the date he was arrested and indicted,” LaHood began. “Then he gets another chance to go home, possibly.”

Brad can also be released if he bonds during that time.

LaHood said the release would be temporary if this case goes to trial.

We requested a copy of the mistrial motion from Simpson’s attorney but have not heard back.
